We Can Help You Reach a Fair Child Support Agreement
In Florida, child support payments are calculated according to a formula set forth in Florida's Family Law statutes. Once the variables for that formula have been determined (and they are usually fairly straightforward), the level of child support has essentially been set.
However, some situations are more complex than others, and sometimes mistakes are made that result in child support arrangements that are unfair both to parents and to children. Calculating Child Support in Florida
The amount of child support you pay or receive will be based on your income, the other parent's income, and your child custody / parenting time arrangement. The calculation of child support differs depending on whether or not one parent has less than 40% of the total parenting time:
- If one parent has less than 40% of parenting time, then child support calculations are based purely on income. Unless that parent gains more than 40% of parenting time, fluctuations in the parenting time arrangement will not affect the level of child custody.
- If both parents have more than 40% of parenting time, then the level of child support changes proportionally with the parenting time / time-sharing arrangement. For example, if your share of the parenting time rises from 40% to 45%, your child support payments will decrease proportionally.
Child support can be modified in response to changing circumstances. If your child custody arrangement, your income or the other parent's income has changed significantly, the court may grant a child support modification.
Child Support for Complex Estates and Incomes
In situations where either parent owns a business, is self-employed, or has multiple sources of income, calculating child support can become complex.
Jeffrey S. Koster obtained a B.S. in Finance from the University of South Florida before going to law school. His background in finance allows him to adeptly sort through complex financial documents, calculate child support payments fairly and often uncover hidden sources of income.
