Separate Property vs. Marital Property

Florida's property division statutes recognize two different types of property: separate property and marital property.

  • Separate property is considered to be owned by only one spouse. Usually, the spouse acquired that separate property before the marriage. It is not divided between the spouses in the divorce process.
  • Marital property is considered to be owned by both spouses. Any property acquired during the marriage can be considered marital property. During property division, all marital property is subject to an essentially equal split between the spouses.

Often, separate property can become marital property if it has been commingled between the spouses during the marriage. For example, if one spouse enters the marriage with a $20,000 checking account, then both spouses start depositing money into it during the marriage, it becomes marital property and will be split equally at the time of the divorce.
