Factors the Court Considers in Determining Spousal Support

The length of the marriage is the most important factor involved in determining whether or not spousal support will be paid.

  • In a long-term marriage (a marriage lasting more than 15 years), the economically weaker spouse is automatically entitled to receive permanent alimony payments until remarriage or death.
  • In a short-term marriage (a marriage lasting 8 years or less), permanent alimony is never awarded. However, the economically weaker spouse may receive temporary alimony payments to help get back on his or her feet, or to continue education.
  • For marriages lasting 8-15 years, there is no way to predict whether or not permanent alimony will be awarded. Judges have discretion to deny spousal support altogether or grant an amount that is appropriate in light of the marital history.

In addition to the length of the marriage, the court considers a number of other factors. What standard of living did the couple enjoy during the marriage? Did one spouse give up a career in order to stay home and raise children? How much money will each party need to maintain a normal healthy lifestyle after the divorce?
